Transfer of Title
If you intend to transfer ownership in a property, add a person or people to a title or remove a person or people from a title, you will need to have a real estate lawyer prepare and register a title transfer for you.
A title transfer is commonly required to add or remove someone from title when:
- A couple separates;
- Parents, children or friends decide to share ownership of a property; and
- When a guarantor needs to be added or removed from title (usually when refinancing).
Your real estate lawyer will be involved in many activities, including:
- Confirming whether there are any liens or debts registered against the property.
- Reviewing any encumbrances, such as rights of way and restrictions on what can be done on the property.
- Confirming that any outstanding property taxes or utility bills are paid before the transfer takes place.
