When you alone apply, you serve your claim on your spouse and they respond. They can dispute your claim or file their own, consent to divorce and request to be served with all your documents or do nothing while the divorce is granted.
Filing jointly with your spouse is quicker. No need to serve documents because you have agreed to divorce. As long as you have been separated for at least a year and both agree, your divorce is normally granted.
Foreign Divorce Opinion Letter
Divorced outside of Canada and remarrying? Before applying for your Ontario marriage licence, ask us for a foreign divorce opinion letter.
Since you are not permitted to be married to more than one person at once in Canada, your application must show you are legally divorced or your marriage was annulled. Foreign divorces are usually recognized in Canada, as long as you or your spouse lived there for at least a year before divorcing or have a “real and substantial connection” such as being born and returning there after divorcing, owning property or visiting often. Be aware “quicky” divorces in foreign countries may not be recognized.
